TERMS AND CONDITIONS OF USE

Account:Has the meaning given in clause 4.1
Australian Consumer Law:The Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth)
Booking Fee:The fee We charge for booking entry to an Event
Data:Any data inputted or supplied by You or with Your authority
Events:Bowls tournaments, competitions, championships, games and other Bowls-related events in NSW
Intellectual Property Right:Any patent, trademark, copyright, or other intellectual property rights
Member:Has the meaning given in clause 4.1
Organiser:Registered club, sporting club, association or entity hosting an Event
Personal Information:As defined in section 6 of the Privacy Act 1988 (Cth)
Services:Online platform allowing users to view events, book transport/accommodation, post comments
Subscription Fee:Annual non-refundable fee payable by You
Terms:These terms and conditions of use
Third Party Providers:Third party providers of products/services (e.g., booking.com)
We/Us:DRT Bowls Pty Ltd (ACN 684 790 449)
Website:bowlstournaments.com.au
You:Any person or entity who uses the Service

3. Use of the Website

Subject to Your ongoing compliance with these Terms, We grant You the right to access and use the Services via the Website.

4. Account

4.1 To access Services, You must register for an Account, pay Subscription Fee, and become a Member for a 12-month Fixed Term.

4.2 Minors must not register for an Account or use Services.

5. Subscription Fees

5.1 Account access ends after Fixed Term unless renewed.

5.2 Renewal requires advance payment before term end.

5.3 Invoice issued one month before term expiry.

5.4 Payment due at least 7 days before term end to avoid disruption.

5.5 Fees may change with advance notice; option to cancel if not agreed.

6. Booking Fees

6.1 Booking Fee applies when booking entry to Events, in addition to entry fee.

6.2 No fee for accommodation booking; commission may be received from provider.

7. Preferential pricing, discounts and promotions

We may offer preferential pricing, discounts or promotions at our discretion. Eligibility requires acceptance of responsibility for all fees.

8. Use of the website and services

Access Conditions

8.1 Use only for permitted purposes under these Terms and applicable laws.

8.2 No commercial use without written consent.

8.3 You must not:

  • Undermine security or integrity of systems
  • Misuse Services to impair functionality
  • Gain unauthorized access
  • Transmit damaging, offensive or illegal content
  • Modify, copy or reverse engineer software

Communication Conditions

8.9 Use communication tools only for lawful purposes.

8.10 No posting of unrelated content, commercial offers, offensive material, or illegal content.

8.11 Exercise caution in communications; we don't verify legitimacy.

8.12 We reserve right to remove communications at our discretion.

Availability of the Services

8.13 No warranty for uninterrupted or error-free service. Not responsible for system interference.

9. Third Party Providers

9.1 Booking with Third Party Providers creates separate contract; we're not a party.

9.2 You acknowledge:

  • Website is a platform for comparing third-party services
  • We don't supply accommodation or travel services
  • Must read third-party terms and conditions
  • Breach may result in additional charges or cancellation
  • We only show providers with commercial relationships
  • Not an endorsement of any third party

10. Links to external websites

10.1 External links don't reflect our views or recommendations.

10.2 No representations about accuracy of external sites; verify information yourself.

11. Termination

11.1 You may terminate by deleting your Account.

11.2 Deleting Account:

  • Ceases membership and access
  • No further Subscription Fees

11.5 We may terminate if:

  • You breach Terms
  • Your conduct impacts our reputation
  • Account inactive for extended period
  • Required by law

11.10 Termination doesn't affect accrued rights.

11.12 On termination, cease using Services and Website.

12. Liability

12.1 Nothing limits rights under Australian Consumer Law.

12.2 To maximum extent permitted by law:

  • Exclude all implied terms
  • Not liable for indirect or consequential loss

12.5 Services controlled from Australia; use in other jurisdictions at your own risk.

13. Intellectual property

13.1 Website and Services subject to copyright and IP rights.

13.2 We grant limited licence while you're a Member:

  • Use Website per Terms
  • Copy/store in cache memory
  • Print pages for personal non-commercial use

13.6 We retain all rights to Website and Services.

13.11 No republishing without prior written permission.

13.12 All other IP rights reserved.

14. GST

Consideration for supply is exclusive of GST. Recipient agrees to pay GST with tax invoice.

15. Privacy

15.1 May require Personal Information during registration.

15.2 Warrant authority to disclose others' information.

15.3 Information must be accurate and up-to-date.

15.4 Keep credentials secure and confidential.

15.5 Notify immediately of unauthorized use.

15.6 Without information, only view events; no other services.

15.7 We collect Personal Information to operate business and provide Services.

15.8 Disclose information to Event Organisers.

15.9 May disclose to third party service providers.

15.10 Booking with Third Party Providers: information goes directly to them.

15.11 Collect information only from you or with authority.

15.12 May send marketing; opt-out available.

16. System Requirements

16.1 Requires Compatible Devices to access Website/Services.

16.2 Upgrades may affect device compatibility.

16.3 No liability for inability to access due to inadequate equipment.

17. General

Entire agreement

17.1 These Terms constitute entire agreement.

Waiver

17.2 Waiver must be in writing.

Delays

17.3 Not liable for delays outside reasonable control.

No Assignment

17.4 Cannot assign rights without written consent.

Governing law and jurisdiction

17.5 Governed by Australian law; jurisdiction NSW courts.

Severability

17.6 Invalid provisions replaced to accomplish original purpose.

Rights of Third Parties

17.7 No third party rights.
